Peter Duce Photography General T&Cs
Session Appointment Fee:
The session appointment fee must be paid at the time of booking, less any deposit or booking fee already paid. Peter Duce Photography does not offer refunds unless Peter Duce Photography is unable to complete the photo session for any reason. Voucher sales are non-refundable under any circumstances.
Late Arrival Policy:
If you are more than 30 minutes late to your session without contacting Peter Duce Photography, you may miss your slot due to other bookings. This will result in no shoot, but the session fee will still be payable.
Travel Charges:
Travel is charged at 99p per mile. This charge is applicable if the photo session location is more than 40 miles from North Petherton TA6.
Force Majeure Clause:
The performance of this contract by Peter Duce Photography is contingent upon acts of God, flood, fire, warfare, government laws or regulations, electrical failure, and/or conditions beyond its control.
Delivery and Responsibility:
If you purchase extra images or prints, they will be sent via post at your cost, or you can collect them from the studio (by appointment). 'Peter Duce Photography' does not take responsibility for non-delivery due to the fault of the delivery service.
Waiver of Liability:
You, the client, expressly release the photographer from all claims, damages, and liabilities that may result from accidents or incidents during the portrait session. This includes a waiver of any claim resulting from negligence.
Image Usage:
'Peter Duce Photography' may upload a selection of session photos to its website and Facebook pages as part of standard activities. If you prefer images not to be used in this manner, please state this before your session and confirm in writing (email) within 24 hours. The images and copyright remain the property of 'Peter Duce Photography.'
Session Fee Inclusions:
The session fee only includes what is explicitly stated. Additional images, prints, or media must be purchased separately during your "in-person" viewing or subsequently if you are provided with an online gallery.
Editing and Retouching:
The client agrees to give the photographer creative freedom in editing and retouching images. Specific requirements must be made in writing before the photo shoot/wedding date. All images will be adjusted to match the photographer's signature style. 'Peter Duce Photography' does not supply unedited RAW files.
Returns and Refunds:
Once you have purchased extra items viewed at the viewing or through your gallery, no returns will be accepted. If you choose to buy digital images, no refunds can be given once you have received them.
Client's Usage and Copyright:
Client usage is for personal use only. Prints for publication require prior written consent from the photographer. Peter Duce Photography grants the client full non-commercial printing/usage rights of all purchased digital images.
Reshoots:
In the unlikely event of complete dissatisfaction based solely on personal preference, Photographer will reshoot at a 25% discount. If the finished product is unusable due to technical problems, Photographer will reshoot at no additional charge.
Weather Contingency:
If a session cannot take place on a scheduled day due to weather, Photographer and Client will reschedule at the earliest possible date at no additional charge, provided agreement takes place at least 24 hours prior to the shoot.
Cooperation/No Shows:
Photographer is not responsible if Client or key individuals failing to appear or cooperate during portrait sessions.
Limit of Liability:
In the unlikely event of loss, damage, or Photographer's inability to attend, liability is limited to a refund or rescheduled session at no additional cost.
Cancellation/Postponement:
Deposits paid are non-refundable in the event of cancellation or postponement by the Client. Deposits are transferable with 48 hours' notice.
Special Requests/Coverage:
The photographic coverage is at the photographer's professional discretion. Special requests are considered but not binding instructions.
Children:
If the subject is a minor, a parent or guardian must legally provide consent for the minor child.
